Terms of Use

Effective August 7, 2026. Please read these terms carefully before using truenorthoc.com or the TrueNorth mobile app.

These Terms of Use ("Terms") are an agreement between you and TrueNorth Omni Care ("TrueNorth", "we", "us") governing your access to our website, patient portal, and the TrueNorth mobile application (together, the "Services"). By creating an account, submitting a membership application, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Not for emergencies

The Services do not provide emergency medical care. If you believe you are having a medical emergency, call 911 or go to the nearest emergency department immediately. Never delay seeking care because of something you read or received through the Services.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to create an account. You agree to provide accurate, current information, to keep your credentials confidential, and to notify us promptly of unauthorized use. You are responsible for activity under your account.

3. Membership

Submitting a membership application does not create a patient relationship. A relationship begins only after we confirm eligibility, complete intake, and you attend your first visit. Membership benefits are described on our For Members page and may change with notice.

4. Fees, subscriptions, and cancellation

Any recurring membership fee is disclosed before you commit. Purchases made inside the iOS app are processed by Apple and billed to your Apple Account; the subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel a subscription in your device's Account Settings. Deleting the app does not cancel a subscription.

5. Telehealth consent

Where you use telehealth features, you consent to receive care by secure video or phone, understand that some conditions cannot be evaluated remotely, and accept that technical failures may interrupt a visit. You may withdraw telehealth consent at any time and request an in-person visit instead.

6. Acceptable use

You agree not to misuse the Services, including by: submitting false information; accessing another person's records without authorization; attempting to breach security; reverse engineering, scraping, or copying the Services; uploading malicious code or unlawful, harassing, or infringing content; or using the Services to provide services to third parties.

7. User content

You retain ownership of content you submit. You grant us a limited license to store, process, and display that content solely to operate the Services and deliver your care. You are responsible for having the right to submit any content you provide.

8. Intellectual property

The Services, including text, design, logos, and software, are owned by TrueNorth or its licensors and are protected by intellectual-property laws. We grant you a personal, revocable, non-transferable, non-exclusive license to use the Services for your own healthcare needs.

9. Third-party services and app stores

The Services may link to or rely on third-party services governed by their own terms. For the iOS app: these Terms are between you and TrueNorth only, not with Apple; Apple has no obligation to provide maintenance or support; Apple is not responsible for any product claim, warranty, or third-party intellectual-property claim; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. embargo and are not on any U.S. prohibited-parties list, and you agree to comply with the applicable Apple Media Services Terms.

10. Disclaimers

Except as expressly stated, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. Content in the Services is for general information and is not a substitute for professional medical advice, diagnosis, or treatment from your clinician.

11. Limitation of liability

To the maximum extent permitted by law, TrueNorth will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD 100. Nothing here limits liability that cannot be limited by law, including liability for professional medical negligence.

12. Indemnification

You agree to indemnify and hold TrueNorth harmless from claims and expenses arising out of your misuse of the Services or your violation of these Terms or applicable law.

13. Suspension and termination

We may suspend or terminate access if you violate these Terms or if needed to protect patients, staff, or the Services. You may stop using the Services and request account deletion at any time. Sections that by their nature should survive termination will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Orange County, California, unless applicable law requires otherwise.

15. Changes to these Terms

We may update these Terms. We will post the revised version here with a new effective date and, for material changes, notify you in advance. Continued use after the effective date means you accept the updated Terms.
